LINUS SIMIYU WAMALWA LOSES A PETITION AGAINST UNIVERSITY OF NAIROBI

LINUS SIMIYU WAMALWA VERSUS UNIVERSITY OF NAIROBI & ANOR.

PETITION NO. 139 OF 2014

 

The University successfully defended a case filed by Linus Simiyu Wamalwa,a former student who had sued seeking the court to compel the University to rectify the grades in his degree certificate,to show that he attained 2nd Class Honors Upper Division instead of 2nd Class Honors Lower Division and compensation for being frustrated. The University won the case and overwhelmed Mr. Wamalwa’s efforts to obtain correct information regarding his degree and compensation for lost opportunities to advance his education and employment for lack of degree certificate to authenticate educational qualifications.

 

The court observed that it could not order for correction of the degree certificate as it is not the right body to do so as it is not a function bestowed to it by law. That he had been given opportunity to access information as his request for correction of his academic transcripts and degree was effected and on compensation for loss of opportunities and income the court refused to grant the prayer and dismissed the entire Petition.
